Enacted on May 12, 2021, through a Royal Decree (Real Decretory-ley 9/2021), the Rider Law establishes that couriers who are managed by delivery platforms through algorithmic control are considered statutory employees rather than independent contractors.

The legislation requires companies to reveal any algorithmic methods employed for managing work assignments, evaluating performance, or executing dismissals.

Additionally, it mandates that couriers be incorporated into social security and labor protections within a three-month period for implementation.

Nevertheless, this case highlights the complexities of Spain’s changing labor landscape.

Just Eat: A Case of Early Compliance

Just Eat foresaw the Rider Law in 2021 and shifted to hiring its couriers. By the middle of 2025, the company had around 2,500 riders on salaried contracts, benefiting from legal protections from the outset.

Uber Eats: A Hybrid Model Under Scrutiny

Uber Eats operates under a hybrid model: certain couriers are hired via subcontractors, while others function independently. As of July 2025, Spain’s Labor Inspectorate has initiated an inquiry into potential violations of the Rider Law. Uber Eats has previously allocated €136 million to cover legal liabilities and is still encountering penalties associated with the misclassification of freelancers.
